Immigrants are urged to request virtual court hearings
​The Immigration Justice Coalition of Sarasota (IJC), a local group of concerned citizens, is condemning ICE arrests of immigrants attending court proceedings and is urging immigrants to seek virtual hearings in place of in-person hearings. See press release below.

Who we are:

​We have an executive committee consisting of members of the Unitarian Universalists of Sarasota and community members.

Mission:
We are a community that advocates for and supports our immigrant, refugees, and asylum-seeking neighbors.

Goal:
To advocate for the rights and fair treatment of immigrants in the area by providing resources, raising
awareness, fostering community support and promoting policies to ensure equal access to justice, safety, and
opportunities for all individuals regardless of immigration status.
Specific Goals and Action Plan:
  1. INFORM: Create public awareness, campaigns and education.
  2. COLLABORATE AND SUPPORT: Establish a support network.
  3. ADVOCATE: Policy Lobbing.
  4. RESOURCE CENTER: Establish a resource center for the coordination of activities and response actions and implementations of the preceding goals.

Action Plan:
  • Distribute “know your rights” red cards and other literature.
  • Provide trainers to churches and community centers to empower immigrants to ‘know their rights”.
  • Educate members of the congregation and the general public about immigration issues through actions such as presenting the documentary “separated”.
  • Provide list of resources and affordable legal services to the immigrants.
  • Organize and participate in demonstrations both locally and nationally advocating for immigrant rights and immigration policies.
  • Support immigrants who are detained for deportation (bonds, legal assistance, child support, food, transportation, etc).
  • Use social media (Facebook YouTube, etc.), radio, TV, press releases, Letters to the Editor as appropriate, to distribute information in support of immigrants and to advocate on their behalf.
  • Invite members of the congregation and the public to contact their legislators with the 5 Calls initiative:

inhumane mass deportation agenda.

RED CARD “Know your Rights”

ENCOUNTERS WITH POLICE OR IMMIGRATION
 Stay calm, do NOT run or resist.
 You have the right to remain silent; you do not have to answer questions about your immigration status
or where you were born.
 Memorize important contact information (such as your lawyer’s phone number).
 NEVER lie or provide false documents or foreign documents.
 NEVER sign anything without consulting a lawyer.
 You have the right to remain silent until you speak with an attorney, even if you are arrested.
 In Florida, if stopped by local police (not ICE), you may need to identify yourself if you are suspected of
a crime.
 If police/ICE arrive at your home: Keep the door closed, it is safer to speak through the door and say: “I
do not give permission to enter my house based on my 4 th Amendment rights under the United States
Constitution.”
o unless you have a warrant signed by a judge with my name on it.
 If officers have a warrant, ask them to show it through a window or slide it under the door.
 Ask what agencies they are, what they are there for, and ask for identification.
 If they try to enter without a warrant, say “I do not consent to your entry or search.” If they force their
way in, don’t resist, and tell everyone in your family to remain silent, even if you are arrested.

EMERGENCY PLANS:
  • Your family must know your: Immigration “A” number, full government name, date of birth, country of origin.
  • Have copies of all your important documents.
  • Should you be detained, they can locate you by visiting, locator.ice.gov.
  • Finances and legal support - Designate individuals to make financial decisions if you are detained. You may need a grant power of attorney for financial institutions.
  • Find an immigration attorney. Save money to pay for an attorney.
  • CHILDCARE - Consider granting power of attorney or guardianship to a trusted adult. Plan for a family member or friend to care for your child or elderly relative in case you are detained.

This panel's presentation in our sanctuary was followed by an open question and answer session. Dale Anderson was our Moderator for the event, which was sponsored by the Unitarian Universalist Immigration Justice Coalition of Sarasota.

IMMIGRATION JUSTICE COALITION (IJC)
URGES IMMIGRANTS TO REQUEST VIRTUAL COURT HEARINGS
The Immigration Justice Coalition of Sarasota (IJC), a local group of concerned citizens, is condemning ICE arrests of immigrants attending court proceedings and is urging immigrants to seek virtual hearings in place of in-person hearings.

Several recent news reports indicate that federal agents have arrested immigrants appearing for court hearings in immigration courts. The tactic is considered an effort by ICE to intimidate immigrants and discourage their efforts to establish legitimate rights to remain in the United States.

Matthew Montavon, executive member of the IJC stated: “This ICE tactic jettisons respect for our legal processes and violates the American principles of justice.”  

Immigration lawyers have raised concerns that individuals skipping court appearances due to fear of arrest may violate the legal requirements of their case, which could negatively impact their opportunity to establish a legal right to reside in the United States. However, going to court to comply with the requirements has turned into an expedited removal process for many. “These arrests are a violation of the rule of law and due process, and will likely be challenged in courts, but only after the harm of ICE detention and possible deportation has been done,” said Maria Lara, executive member of the IJC and a local immigration lawyer.  

The American Immigration Lawyers Association (AILA) has issued formal statements regarding the court arrests and considers them “a flagrant betrayal of basic fairness and due process,” and adds that “this is a corruption of our immigration courts, transforming them from forums of justice into cogs in a mass deportation apparatus.”

“For these reasons, the Immigration Justice Coalition is spreading the notice to immigrants to ask their counsel to request that the hearings be conducted virtually on video, where legally possible, instead of in person,” concluded attorney Lara.”
